If my Mother moved to a Skilled Nursing Home on March 8,2010 is it to late for her to deed her home to me which I have lived in more then 30 years????

Hi dbillybowler,

Will your mother be taking medicaid help? If yes, then transfer of property would result into a look back period of 5 years and she may not remain eligible for medicaid benefits.

Hi BC,

As far as I know, in order to recover the costs, Medicaid will be able to takeover the property from your mother.

But can they make me move out????
I have been in this home for more then 34 years and now at age 50 I feel it would be so hard to start over after putting my life not to mention a lot of my own hard earned money over the years in to this home also.

Hi wc,

Though you lived in the property for the last 30 years, you are not one of the owners of the property. Thus, you do not have any legal rights to the property. So, you may be asked to leave the property.

What if the home is in a trust and has been willed to me???
Does this matter?????

Though the property is in a trust, I guess the Medicaid can still place a lien on it and sell it off. You should contact an attorney who is an expert in the Medicaid laws of your state and take his opinion.
