It will be difficult for you to prove that you live there. Nevertheless, you should speak to a real estate attorney and take his opinion in order. As your mother is the owner of the property, there are chances that Medicaid will take over the property if she goes for Medicaid benefits.

My friend and I have a home together with a warranty deed with rights of
survivorship in july 2007 can medicare take the home if she goes in to a nursing home she had money to care for her for a few years I am also her power of attroney .

Hi Denise,

If your friend has the money to care for her, then she will be able to pay for her medical costs. In such a situation, Medicare won't take her property.

mom owns her home and is on medicaid, will medicaid take her home when she dies if i am on her deed

Medicaid may take away the property. However, if you pay off the medical dues to the Medicaid, then they won't take away the property from you.

The "taking" of a home is a whole lot more complicated than what I see described here. If you've got legitimate concerns about this, you ought to consult with an attorney who has expertise in foreclosures.

When someone gives you a blanket "they'll take the house" answer, question it and question it not to the writer but to legal counsel.
