Sick Father

Posted on: 06th Aug, 2007 09:35 am
If my father remains too sick to come home and has to stay in a nursing home for a long period of time until his insurance and medicaid run out then as I understand they will come after his assets for payment. His home is paid for but my question is can he quick deed the house to one of his children so that the nursing home will not come after it for payment. He worked very hard all his life and this is his only real asset which in his will is to be sold and divided amongst his children. Please advise.
Is there not a neighbor who might vouch for your having stayed there for so long? Does nobody know?

My friend and I have a home together with a warranty deed with rights of

Hi Denise,

If your friend has the money to care for her, then she will be able to pay for her medical costs. In such a situation, Medicare won't take her property.

Thanks

Welcome Guest,

Medicaid may take away the property. However, if you pay off the medical dues to the Medicaid, then they won't take away the property from you.

The "taking" of a home is a whole lot more complicated than what I see described here. If you've got legitimate concerns about this, you ought to consult with an attorney who has expertise in foreclosures.

When someone gives you a blanket "they'll take the house" answer, question it and question it not to the writer but to legal counsel.

how to find out if their a lien

Hi bobf!

Welcome to forums!

You can go for a title search in order to find out if there is a lien on the property.

Feel free to ask if you've further queries.

Can NY medicaid put a lean on a home of an adult child who lives in another state. The parent is deceased and left no assets. The childs home was never owned by the deceased parent.

Mom passed away and medicaid wants 58,000 paid back to them because they said her house she sold a year before she died, and they got the money for was undersold. They agreed to the sale price and a year later changed their mind. She left no estate and I live in florida. They want to hold me responsible for the debt. Can they???

Hi ann,

If the child's home was never owned by the deceased parent, then medicaid can't place lien on it.
