My mother pass away in 2007 and she did not have a wil but she own her home which is the homestead and own other property. My brother went to this lawer and did a protition deed and divided up the property between frour kids living him with the homestead. Will he be able to give the homestead to anyboby and will his exwife be able to claim my mother house.

I don't think your brother's ex-wife will be able to claim your mother's house as she won't be considered as one of the heirs to that property. As far as homestead is concerned, your brother can give it to anyone he feels like.

Not as long as the four children are on Title. Did you get a copy of it when it recorded? If not, you need to, to confirm all four children own the property.
