taking a name off of a deed

Posted on: 22nd Mar, 2008 05:53 am
My mother put my name and my brothers name on a deed for a condo in Fl. My brother does not want to help financially anymore to pay the maintainance etc...there has been ongoing disagreements regarding this property. My mother wants to take his name off of the deed. Is this possible?? Thank you.
Hi Al!

Welcome to forums!

Unless she signs the quitclaim deed and transfers the property back to you, you won't be able to remove her name from the property deed. You can negotiate with her and buy her out by offering her a certain sum of money and ask her to transfer the property to you.

Feel free to ask if you've further queries.

i have a house in florida and when i purchased it i was young and my parents thought it would be best that they be on the title of the house. now i'm older and they are having issues applying for homested in maine. they are living in maine and always remained maine residentes and i'm here in florida. can they still file a quit claim deed from maine with a notary witnessing the signing in maine? can i still file it within my state of fl?

Hi tfnmal!

Welcome to the forums!

As the property is in Florida, your parents will have to use a quitclaim deed applicable in Florida in order to transfer the property solely to you. As far as notarizing and filing the deed is concerned, you need to contact an attorney based in Florida and take his opinion.

Feel free to ask if you've further queries.

Hi! I am on the deed from a house my husband and I owned. We separated and he got a 2nd mortgage loan to pay his debts. I signed an agreement with their bank officer, that if anything happened to him, I would not be responsible for that loan. He is now deceased and the loan company took over the property and locked it up for foreclosure, but then didn't want to foreclose. They sold to another collector, who sold to another collector, and then another. I just want my name off all of this. What can I do?

Hi Chelley,

Well, you can surrender the property to the bank. But before taking any further step, you should consult an attorney in this regard.

Thanks
