My father in law is deceased and his vehicle at the time of his death was in another state from where his was living
our family needs to get the car back does his wife own the car or does his estate own the car. We declared the car as part of his estate in PA but the car was in NY.

Hi felicem,

If the car is jointly owned by the husband and wife, then the wife is now the owner of the vehicle. If the husband was the sole owner of the vehicle, then the wife or the heirs need to transfer the property in their name.

if a car was titled by two unmarried people who owns the car after one dies and is half of the value belong to the estate

The person who is still alive will own his/her share of the property and the heirs of the deceased person will be the owner of the other half of the property.

Something funny in that response. If two people own a vehicle and one passes, in normal situations the title would revert to the survivor in most cases. To issue a blanket statement that the heirs of the deceased would be half-owners would seem to be misleading at best, given the lack of information provided upfront.

In this case, what does the law of the state in which the vehicle was titled specify? I think that'd be the rule; not the opinion of a third party.
