Our father passed away in May 2010. His surviving spouse sent us paperwork and requested that we take ownership of family land he owned in Texas. She specifically wants my husband to have sole ownership of this land as he is the oldest son and has shown the most responsiblity of any of 4 children. What do we need to do to get the property in his name? thanks for your help.

Hi bsweete,

If there is no will, then your spouse can file an affidavit of heirship at the county recorder's office and get the property transferred in his name.
