My husband died just recently and the title on the deed has us as, Husband and Wife, as community property, do I have to probate this or can a file an affadavit of death?

i do not think that you need to go to probate. Is your husband signed a valid deed? if not, there is no dispute you need to file affidevit to court for transferring the ownership right.
