We bought a vacation home 3 years ago, got financing together, she lost her job and could not keep up the original agreement (only Verbal) we are no longer a couple, she had another problem with a home and quit claimed our vacation home to me, a year has passed. I've since removed her name from the bank financing as to refi at a better rate and fullfill a obligation to the original owner, I only, continue to pay for the property. she won't leave the property and has even changed the locks, claims its her residence but works 100 miles away 5 days a week. has not paid any up keep or utilities, she needs to go so I can enjoy what I'm paying for, yes she has some monies in it but its $10K to my $60k over the 3 years with months of none payment, any suggestions?
Quit claim should legally entitle me to move her out?

I want to do the right thing.

Hey Joe,

This is a very common case, happens all the time with couples. my advice is to go to your attorney and see what else can be done.
Since she has paid $10k into the property, one of the only ways to make the property 100% yours is to buy her out. Pay her what she has put into the house and refinance under your name only.

Hello joe?

You may claim just one credit between the two of you. You may divide the credit using "any reasonable method" as long as both of you are eligible to claim the credit. If one of you is not eligible, it is OK to assign the whole credit to the other one who is eligible.
