Bought a house with a girlfriend 3 yrs. ago. Both of our names are on the mortgage. After a year, she kicks me and my daughter out- literally, as in i came home from work to find our stuff out in the driveway. For the past 2 years, she has been living there, making the payments etc. I recently recieved a letter from her lawyer requesting me to sign a quitclaim deed. There is no equity in the house thus far. What are my rights?? Cant afford to be sued-

Hi wades70 ,

Welcome to Mortgage fit,

You can sign the quitclaim deed only and only if she is going to sign the document where she agrees that once you sign the quitclaim deed she will refinance the property on her name only...If you do not do this then you will be in big trouble if she does not pay her mortgage on time....

So you are advised to ask her that she should refinance the mortgage completely on her name otherwise you will not sign the quitclaim deed...

Before siging quitclaim deed just check out whether she qualifies to get refinance or not...If she doesn't then there is no point in signing the quitclaim deed...
