A couple years ago I bought a home in florida and at the closing i added my girlfriend to the title. The mortgage is in my name only. Now I want to remove my girlfriend from the title. Which is better for me to pursue a quitclaim deed or a warranty deed?

Hi Mark,

Welcome to the forum.

In this case you cannot use a Warranty deed because your property is a mortgaged property. You should use a quitclaim deed to claim deed.

Actually you cannot remove her from the deed. Only if she quitclaims back to you then her name will be removed from the deed.

I checked out a quitclaim deed form on the internet and it is asking a question about Prior Grant Information such as volume number, page number, and county. The web site with the quitclaim deed form says Information pertaining to prior grants of your property (such as the book and page number it was recorded on) can be obtained from the County Recorder's Office. I called the county clerks office and they have no idea what "Prior Grant Information" means. Do you have any clue to what Prior Grant Information means and where can I find it?

I don't know what a prior grant information is. But as far as quitclaim deed form is concerned, you'll get state-wise sample forms from the forum thread on Quitclaim state-wise forms . In case you don't find your state form there, let me know and i can then help you find one.

The prior grant is probably the grant in which you received the property interest. The information is probably on the deed from which you received the property. Check for the county recorder's file stamp.

Cool thanks! One other question, in the quitclaim deed do I put me and my girlfriend as "grantors" or do I just put her as the "grantor" and me as the "grantee"?

Hi Mark,

Welcome back.

Since both of you are on the title, so the deed should mention both of your names as grantors and you as the grantee. That is, it is a transfer of property-interest from you and your spouse as grantors to you as grantee only.

She is quitclaiming to you. So she would be the grantor and you would be the grantee. You don't quitclaim to yourself.

My husband and I want to deed our home to our children due to our age, which is better? If we do, do we have to register this at the county court house?

Hi sunday

You can use a quitclaim deed to transfer the property to your children. Once you sign the quitclaim deed, you will have to notarize it and record it at the county recorder's office.

I and my wife have been divorce for 12 years. We had bought a coop apartment when we still married. She paid all the money and she owns it.
My name is still hanging with it. I want to remove it from mortgage but bank is giving hard time. What should I do?

Hi Chandramani,

You cannot remove your name from the mortgage. Your wife needs to refinance the mortgage to remove your name from the mortgage docs. You can try convincing her to refinance the loan.
