the mortgage was refinanced and the payments we put in my name. How can I go about changing the deed to my name or is that possible.

Hi divalious,

You will have to ask the present owner of the property to sign a quitclaim deed and transfer the property to you. This will make you the owner of the property.

Welcome divalious,

I agree with James. Also, in order to draft a quitclaim deed, you can contact a real estate attorney. He will not only help you in drafting the deed but will also help you in filling it and recording it at the count recorder's office.

diva...I really don't understand how you managed to become responsible for the payments on this mortgage without having an ownership interest. Are you absolutely certain that you're not an owner of the property already? No self-respecting lawyer would have handled this transaction for you without assuring that you have an interest in the real estate being held for collateral. By the same token, no lender in its right mind (that's a mouthful!) would allow you to be the sole party responsible for payments without your ownership also having been established.
