If a person is going through divorce and wants to buy a house before the divorce...How does the soon to be ex-spouse release his claim or reponsibilities regarding the new house?

you'd better check with your legal counsel on this process - you could have issues, obviously, purchasing while still married but in the process of divorce.

If both people are on the current mortgage, then the one that is going to keep the property needs to refinance to take them off the mortgage loan. At the same time, the title company can prepare a quit claim deed to remove the other person from the deed.
