HI,

I bought my first place last year and with the fiancial support of a friend (a guy helping to put the deal together and paying the mortgage) he was put on the deed. He has now turned out to a real dead beat with creditors chashing him down left and right. I want to get him off the deed before any liens are put against it. The mortgage is solely in my name and he won't contest my trying to get him off the deed. BUT because he is such a dead beat I need to have this happen in one day because to track him down is hard to do.

Do you have any suggestions? Quickclaim? Title Companies?

Bender you use a quit claim deed to remove your friend from house title. What you need to do is prepare all the documents and if you can get hold of him for some time, take his signatures and have the deed notarized.

Yeah I too think there should not be any problem in removing him from the title as he is not named on the mortgage.

You are right that if it stays as his property then a lien can be placed by creditors to recover the debts he owes to them. Quit claim deeds is a very simple property transfer document mostly used and you will not have much difficulty in completing the transfer as soon as you can have him for some time.

Thanks everyone...I haven't done a quitclaim yet. Does anyone have any suggestions at to where to get the forms I need???

I've seen some forms online but I didn't know if they are just genaric or should I be using something a little more formal....

Hi Bender,

Welcome Back.

You can get the quit claim deed form used in your state from this page ( Statewise Forms on Quit Claim Deed ). Download the form from the site mentioned on that page and show it to your attorney. He will tell you if it can be used for your purpose or if any other modified format has to be used.

I must also tell you that you can get the form from many other websites also but after you download it do show it to your attorney and take his help in completing the details on it.

You will find a lot of quitclaim forms online but you should use only the one that is approved by your state. I'm not aware as to whether you have gone though the page mentioned by Blue. But in case you don't find your stae form there, let me know which you are in. Then I shall be able to provide you with such a form.
