live in a apt.. but my credit is bad now casue he is late... now his new family (girlfriend and new child) now I would like to get my name off of the mortage how do I get my name off.. his credit is bad and I know he will not be able to refinance... so what can I do to make him leave the house.

You definitely need to consult with an attorney first. The only way to get you off the note is for him to refinance the home. If you have a legal document that states he is responsible for making the payment, you MIGHT be able to get any late mortgage payments removed from your credit report after the paper if filed.

Hi lcyntanner,

Welcome to the forum.

Are you also on the mortgage? If that is the case then you cannot get your name off the mortgage documents on your own. Only if your ex refinances the mortgage on his name then only you will be relieved from the mortgage.

Novation is another way. But lenders do not always agree for that. Consult with your lender if he can allow for that.

I agree that an attorney is the way to go -- your 'ex' is jeopardizing your future by going late on the payments.

You need to file for formal separation or divorce. You need to force his hand out of the house, especially if he is paying late. Otherwise, you might consider selling the home, with his permission -- again, an attorney can help you.

Also, you might consider going to the Title Company -- where you signed the mortgage -- and talk to them. Many escrow officers inside title companies have 'heard it all'! They might be able to direct you 'free-of-charge'.
