There are three of us on our mortgage, but one of us wants out- is moving to another state & wants no proceeds from the eventual sale of the house, so does not want to contribute to payments any longer. The remaining two are agreeable with this. We are in Oregon. What is the best way to get her off the mortgage/title of the house?

Hi sheileeb!

Welcome to forums!

The person who wants to get out of the property deed will have to sign a quit claim deed in favor of the other two owners. This will help her in removing her name from the property deed. Once the property transfer is done, the other two owners will have to refinance the mortgage in their names. This will help them in removing her name from the mortgage.

My wife took me off of our home title and put her mother on it, which I reluctantly allowed. In doing the quit claim deed the lawyer never asked if I was on the mortgage with my wife and did the quit claim deed. Now trying to refi it's confilicting and I am being told that was an illegal move, what kind of recourse can I take to punish the lawyer and/or get myself in position to be in a legal status?

Welcome dudewantingtorefi,

Unless your name is mentioned on the property deed, you won't be able to refinance the loan in your name. You should ask your wife to add your name back to the property deed and then refinance the loan.

That is exactly the predicament I am in, adonis. I also wanted to know if I can do anything against the lawyer that allowed this? We honestly didn't know and the lawyer didn't advise us or we would have not done such a stupid thing on the title! It's quite maddening!!
