Removing spouses name from deed

If my husband filed a quit claim deed removing my name from the deed of our house, wouldn't a copy be kept at the register of deeds? If there is no copy of that at the register of deeds, how did he have my name removed from the deed? I did not sign a quit claim deed or anything else authorizing anyone to remove my name from the deed of trust.

Sounds like fraud to me if you did not sign it. You would have had to have that document notarized. Something is not right with his story.

Hi carolee,

Your name cannot be removed from the property deed without your signatures. You will have to sign the deed and transfer the property to him. I guess, your husband took some illegal means to remove your name from the property deed. You can take legal actions against your husband. I would suggest you to contact an attorney.

Hi peter,

If your name is on the property deed now, then you would be considered as one of the co-owners of the property. Your wife cannot forcefully remove your name from the property deed. You will have to sign a quit claim deed in her favor and remove your name from the property deed.

carolee's case is one i never had read before, but i just want to say that her husband could merely be putting up a smokescreen.

and the husband whose wife wants him off their deed - well, that would have to be a quit claim deed but she'll have to refinance also. if you quit claim your interest in the property then it's no longer yours.
