I had my home 10 months before I was married and my wife put her name on the title but not on the mortgage how do I get her name off so i can keep my home

Hello- You can use a quit claim deed to remove her name from title. She has to sign it.

Hi walter foster!

Welcome to the forums!

If the person is a co-owner and refuses to sign the quitclaim deed, then you can buy-out the co-owner. This means you can offer certain amount of money to the co-owner and ask him/her to give away the property to you. If still the person refuses to give away the property, then you can file a partition law suit. It will help you to sell the property and get the money.

aprilmarie, your wife could not have put her name on title to your home by herself; it would have to be done with your stamp of approval. if you now disapprove, the key is to negotiate. i don't know if a buyout is the proper method, and certainly a lawsuit is the last thing you'd want to do. how about the two of you sit down and discuss the situation and see what kind of amicable solution you can dream up? not everything in life needs to be contentious.

Hi,

Actually you wife is co-signer so whithout her approval you can not remove her name. So you can go through quit claim deed .

A quitclaim deed is a term used to describe a document by which a person disclaims any interest the grantor may have in a piece of real property and passes that claim to another person .
So my advoice is you discuss with your wife or pay some amount force her to agree for quit claim deed.

But before that It also also important in the case of a quit claim deed for you to consult with a tax adviser to insure that you will not be liable for any income or gift taxes from the transfer of the property.
