My wife and I are divorcing, she has agreed to give me the house as a part of the settlement. My intention is to sell, but do not want her to have any ability regarding the decisions made in connection with a sale or if I choose to keep it. (If I do keep it, fully aware that I have to re-fi to get her off the mortgage).

Her lawyer wants us to use an Interspousal transfer, but I have also been advised that a Quitclaim will better protect my interests and fully take her name off the grant deed.

Can you please give me as clear an answer as possible?

Thanks!

Hi evigdor,

A quitclaim deed or an inter-spousal transfer deed both will help you in removing your wife's name from the property deed. However, if you want to remove your your wife's name from the mortgage, then you'll have to refinance it.
