what if my mom only owns the rights of some piece of the property? How should we go with it? My mom died 2wks ago and has no will.

Hi jam,

You will have to contact the county recorder's office and file an affidavit of heirship. This will help you transfer the property in your name.

Your Mother's Estate will have to go through Probate is she didn't have a Will or Living Trust. You can use a Probate Attorney to assist you through the process - Suzy Orman also offers a product that'll enable you to do the Probate process yourself, but I'd use an Attorney instead, if you can.
