My case is as follow, when my mother died, my father did a enhanced deed for me and my brother, than a year later, he decided he want to sell me the house, for which I gave him 35,000. as down payment, and agreed to pay him $600.00 a month, and we did a contract of sale, this was on May 2007, than on Oct 2007 he did a revocation of the deed, but now in Feb 2009, he decided that he want me to retrn the property back to him.Can he do that.can he brake the contract ?can he have sold me the house, when I was in the deed.the name of him, my brother and myself, still shows in the title.

First of all let me know whether the contract of sale registered. If it was registered then you have a strong point to get it solved mutually or by entering court of justice.

the contract was notirized with witness, but not record in court.
Can I have bouth the property and be in the enhanced deed at the same time.

Hi

Why did you not record the contranct? That wasn't a wise thing to do. Anyway, if it was notarized and witnessed, it should be valid and your dad has to honor it. You also have your name on the title. So, I don't think it's gonna be easy for your dad to get the property back unless you give it up. But you better consult an attorney and get his assisance to resolve the issue.
