My 86yo mother-in-law ownes her home. She wants to sell. Value unknown. She was in a nursing home under Medicaid recently. If she sells the home what should be done with the money? She wants to divide the money amoung her 3 children. Will the children have to return the money to Medicade if she is admitted to a nursing home? If the home is not sold can MCD attach the home after death for payment for her stay in a nursing home?

Welcome barbara,

If your mother-in-law sells off the property now, she may not remain eligible for the Medicaid benefits as they have a look back period of 5 years. If the property is not sold, then medicaid can sell off the property in order to recover the dues.
