Hi

If your deceased mother is still on the title, you and your brother do not own the house legally and thus, do not have the right to sign over the property to anyone. The first thing, you need to do is to file an affidavit of heirhship with the probate court so the title could be changed in your name. Once you have your name on the title, you become the legal owner of the property. Then you can keep the property to yourself or sign it over to your step father if you want to.
