I am in a situation where my mom and dad left a will that the land be split between me, my brother, and sister. My mom passed away in 2003 and my dad passed away in 2004. My brother got a quit claim deed done for the land and got me to sign 5 days after my dad died. We have a chicken farm, but it's not listed on the deed, just the land is. I am suing my brother because he told me to sign the deed so he could run the farm. Now, 4 years later I am finding out about all of this. In nov of last year, I went to him about my part of my land and he told me, what land? Im very angry at my brother and sister. They have been splitting the money between each other from the farm and I have not received anything. Do I have a chance?

Did your mom and dad have a will set up? Is there anything or anyone that would testify on your behalf of what their intentions would have been. I would think if you sued them in civil court you should win at the least your part of the production of the farm, they would have to provide all financial paperwork and show that they split it up between themselves. Since the business was not part of the quit claim I think you have one hell of a chance at winning. Did you call an attorney on this yet?

Hi Smith,

Welcome to our forums.

Your brother shouldn't have done so with the farmland. But what I feel is, you should have been a bit careful while signing on the deed. Had you read through what's written on the deed, you wouldn't have come across this situation. Now the only way to get the property back is to take help of an attorney and take legal action if it is at all possible to win through the situation.
