My name is on a house with my mother, we are joint tenants. My mom has taken very ill, let her health insurance lapse and is in the hospital. In the event of her death, will the entire house become mine through right of survivorship? What about the debt she accrued while uninsured at the hospital? Can the hospital put a lien on the house? On her half? She left no POA, no will, nothing but a huge mess.

Hi mariemilystevens,

In joint tenancy with right of survivorship when one of the joint tenants dies, the other gets the ownership of the deceased's portion straight away. Thus you will own the house when she dies through the right of survivorship. However, the hospital can place a lien on the house.

owning as 2 individuals in joint tenancy, then one dies, does it have to say "with rights of survivorship" for the survivor to take complete ownership?

Yes, the clause of "with rights of survivorship" should be mentioned in the property deed so that the survivor can take complete ownership.
