Do you have to have Title Insurance to give a warrenty deed?

Given a choice, warrenty deed or Quit claim?

Welcome sm,

If the property is free and clear of any liens, then you can use a warranty deed in order to transfer the property to someone else. A warranty deed is considered a better option compared to a quitclaim deed.

where can I find this sd hsrd copy?

I am bartering for property, the other pasrty is being ill advised and for some reason will only do a Quit C D. I agree with you 100% but am at a loss as to convince them otherwise. Daddy is saying he has always DONE a QCD. I am going to the court house in the AM to do a search. Seller says it is free and clear,

If the seller says that the property is free and clear, then it will be a better option to go for a warranty deed in order to get the property transferred. You can contact a real estate attorney and he will assist you in getting the warranty deed drafted.

Compromise and do a simple grant deed. Do not use a Quitclaim Deed if you are purchasing a property.
