I sold my house by signing over the warrentee deed because I was losing my home, but the loan continues to be in my name, the sale was never recorded, and this person continues to live in the house for nine months without making payments and is damaging the property the bank is going to foreclose how can I get the property back, the bank shows I still own it

The Deed is the legal document that says who owns the property. The note ways who owes the money. It sounds like you sold the property, but did not release your liability from owing on the property. If the Deed was never recorded, maybe you have a shot. You need an attorney that knows real estate to consult with in your area.

Hi nursebetty,

If the sale of the house was never recorded, it should not have any legal validity. In that case, you still have ownership of the property. As far as the mortgage is concerned, you are still responsible for it. Even if you have transferred the property through warranty deed, the mortgage still remain in your name. Until someone else refinances in his/her name, you are not released from your mortgage liability.
