My husbands father passed away 2 years ago. There are 5 siblings and we just got affidavit of heirship so that all the properties can be sold. 4 out of the 5 siblings agree on the offer made on the property, but the 1 does not. What do we do next?? Can we over rule him since the majority rules??

There was no will.

Thanks,
Linda

Hi lkjohnson,

You cannot overrule him as he is one of the owners of the property. But you and your other siblings can buy him out so that he transfers the property to you and then you can sell off the property.

Thanks
