Hi I have a house in Ca.with a mortgage still on it .Can I add my Son and Step daughters names to the deed? they are both grown and live on the property as do I. Also how do I keep control of property? and what paper work do I need?

Do you want them to be financially responsible for it as well? Or just have ownership rights?

If you want them to be held responsible for the payments, you will need to do a refinance. If you just want them to have ownership rights you can sign a quit claim deed or grant deed at your title company and this will add them to the property.

Hi plastered,

To add your son and step daughter's name all you need is a quit claim deed. But the deed cannot transfer your financial obliigations. Thus, as Ashley mentioned, if you want them to take care of your mortgage payments you need to get the mortgage refinanced in their name.

Can I add my two children to the deed as 24% owners and myself as 52%owner? I will still be paying the mortgage and just want the kids to get the house if somthing happens to me.Would I use a grant deed for this?

You could do that, or just draw up a will. But make sure you speak with a financial person to do this, there are many ways to draw up a will and if it isn't the correct one, your house will still go into probate.

Hi

I believe you can add your children to the title just by signing a quitclaim deed and you can transfer any % of your share in the property to them. You can also retain a life estate for yourself while quitclaiming. But since there is a mortgage on the property, you may have to inform the lender.

Hi Guest,

You should contact a real estate attorney who will draft the deed for you in order to add your children to the property. After you fill out the deed, you will have to notarize and record it at the county recorder's office.
