My G-Mother died and we assumed all was left to my G-Father. We couldn't find my G-Mother's will so when my G-Father died we probated his will. My Mom and Dad ened up buying the land from the ohter Kids. They used an attorney and now they deeded the land to me and my brother. As we were going thru the process of getting a loan to build a house the title company told us that we would need an Affidavit of Heirship because my G-Mother's will was not probated. We did that and now it has to go before a Judge.

I don't understand why we have to go thru this is my parents bought the land legally from the other siblings and the deeding of the land went thru the judge also. Please HELP!

Welcome beairdjerry,

Your grandmother and grandfather were the original owners of the property. After your grandmother's death, your grandfather should have filed an affidavit of heirship and transferred the property solely in his name. This would have saved you all from filing an affidavit of heirship now.
