From the surface it would seem like you may need to refinance this property into your name. This would obviously be pending the bank approval. If it is, then you will have to get a quit claim deed signed by your brother, whereby he would transfer the property to you. If there is an existing mortgage on the property in your brother's name, you will have to do a refinance to change the name on the loan.
