my commen law husband of 12 years has decided to leave me and said he would give me the house. my name is not on the deed. if he does a quit claim deed will the house be in my name and can i sell it? he also has a second mortgage on it do i have to pay it?
Hi pinky,

If your husband quitclaims the property deed to you, you will be the legal owner of the house. You can then sell the house if you want. You will not be responsible for the second loan on the property. But in order to avoid any lien being placed on the property, you need to keep up with the payments towards the second loan.

with just quitclaim deed on your name, you will be authorised owner of the house.so do not worry about its legitimacy. but again as a moral concern make sure you pay for the second mortgage even though legally you are not bound to do that.
