My husband was divorced in 2003 and some how the quitclaim deed signed by his ex-wife is nowhere to be found in either divorce file or the county. The divorce was amblicable (sp?) and they are both remarried. My husband kept the house in the divorce and she purchased a house soon there after and made sure the quitclaim deed was filed so she could get financing for her new home. When we went to refincance a year or so ago the mortgage company couldn't find the quit claim seed but saw that my husband did refinacne right after the divorce so they went through with our refinance and put my name on the mortgage (lucky me). When our tax bill from the city comes every year it has the ex-wife's name on the bill along with my husbands and the only way to fix it is to provide the city with a copy of the quitclaim deed....which can't be found. My question is can we just file another quitclaim deed with the county? Can I use the generic forms online? I am a notary can I notarize it myself or not? thank you

You can't notarize your own documents, you need a 3rd party notary. As long as all parties agree again, I don't see what the hold up would be over another quit claim deed.

Hi Teri,

I don't think there will be a problem with signing another quitclaim deed with the county. But as Shane has said, you will be requiring a 3rd party notary.
