My husband will not file his tax returns, I have filed sperate and head of house hold because he does not support the family and has abdoned the family. He was in jail when I purchased my home, I was told because we were married I had to add him on the home. Now I am facing foreclosure after paying chapter 13 by myself and I cant get refinanced because I found out he had this debt. I have been trying over 1 year. What is the best way to get him off the house. Will quick claim deed do

A quit claim might do. Are you still married? If so, maybe not. This is a tough one, and you really need to consult with an atty. I would say definitely do the quit claim, regardless, to avoid any future liens.

Is he on the mortgage, as well? If he is, then just getting him off the deed will not be enough. I don't understand why you were forced to put him on the deed in the first place, especially if he was in jail, so he couldn't have been making a lot of money.

Hi nnbruton .

Welcome back. You can ask your husband to sign a quitclaim deed to transfer the property to you. If he doesn't sign the quitclaim deed then you cannot remove him from the deed. BTW I have answered you question at http://www.mortgagefit.com/problems/foreclosure-taxlien.html
