Mortgage quit claim?

My husband & I are divorcing and we want to take his name off the mortgage, is that possible through quit claim or is there a way to do it without refinancing?

Hi Dana,

A quitclaim deed won't help you to remove your husband's name from the mortgage. You'll have to refinance the mortgage in your name in order to remove him from the mortgage.

Thanks, Jameshogg, for your reponse! I have recently found out that I may be able to do an assumption with my existing mortgage company and then a quit claim to take him off the deed. Does that sound correct? Sorry to be so slow to respond. Life has been hectic!!!!

Welcome Dana,

It is quite a good option to assume the mortgage and then ask him to sign a quitclaim deed in order to remove him from the property deed.
