My ex husband refuses to sign a quit claim so that I can remorgage property that we had filed through legal separation documents that I am sole owner of. We filed bankruptcy so it has taken several years to be able to apply for a new loan. Is there anything I can do to make him sign? The property is in NC

Hi Elle!

You can try out the option of buying out co-owner. In this process, you will have to offer a certain sum of money to your ex-husband and ask him to leave the property in lieu of that. Hope this helps you.

relle, if your separation agreement specifies that he must quit claim his interest to you, and he has failed to do that, you can seek further assistance from the courts to try to force his hand.

failing that, as an owner of the property, he'd have to agree to any new mortgage and be a borrower along with you.
