this took place in may at which time he asked for nothing now he wants 25,000$

Get an attorney immediately.

It sounds like he signed away his right to the house. It is convenient that he didn't want anything to do with it before, but now he wants some profit. I don't think he will get any.

The question is Why did he sign a quitclaim in the first place?

I assume you have been making the payments since then?

I already have an attorney. He signed the quitclaim giving me the right to go to the bank and refinance the house in my own name. Now i am trying to get child support from him and he thinks he doesn't owe me any because he got nothing from the house. he didn't ask for anything when i bought out the house. he signed the quitclaim so i could refinance the house in my own name. absolutely i am making the payments.

I would have to agree with Eric on this one. It appears your ex husband signed over his share of the equity once you assumed all responsibility of the home loan and deed.

Hello Robin,

If your husband really wanted to have a share of the property, he should have decided that before the quit claim was signed.
Now that it's in your name and even the mortgage is also under you, I don't think he will be able to get anything.

What a piece of garbage.

I don't think you have anything to worry about.

What is your attorney saying?

What state do you live in?

Especially since you got a mortgage and have made all the payments he should not have any right to anything and the best part is he is going to have to pay you child support. Hang in there sister.

I learned this from experience. Keep a record of every last expense you incur from now on. Every receipt, record, etc. of anything that you and your children do. Not that it will be necessary but if it ever comes down to it in most states you can sue for back child support at any time. Even after children grow up. I am all for mom's or dad's who go after what is rightfully theirs. At a bare minimum they deserve at least half of the money they missed out on by fulfilling their obligations as a parent. Not that you wouldn't have done it anyway but you still deserve the support.

A deed relinquishing a person's rights, title or interest in a property to another person or entity with no guarantee that the person has a right in that property.

Unfortunatly this happened to my friend a few years ago. He refied the property and took money out before the divorce was over. went to court because see wanted half the amount she was entilted to while they were married. the court favored her because 1. there was no contract made and 2. the deed states giving up rights of the propert know, not the money invested when you were married.

Hope everything works out in your favor good luck, dont like to see these things happen.
