I have been divorced now for 5 years...in the divorce decree it states that the house was to be sold...and if the house is not sold in a timely manner....and the mortgage was not being paid then the ex-spouse was solely responsible for the home. Long story short...I am now trying to build a home and I found out during my pre-approval that the house is currently in foreclosure...I filed bankruptcy almost two years ago and am now being told that I cant get a loan approval because I am still responsible for that house. Is a quit claim deed something that I need to have filed so that I can move on with my life?

Welcome syb,

A quitclaim deed will only help you transfer the property to your ex. But it won't help you in removing your name from the mortgage. You can show the divorce decree to the lender which states that your ex will be fully responsible for the home if the property is not sold off on time. It might help you in getting a pre-approval.
