I signed a quitclaim deed to my ex wife. I understand that it doesn't take my name off the mortgage. Is there any legal recourse I can take to get her to remove my name off the mortgage?

Unfortunatley, without a miracle from the lender, the lender would be reluctant to take off any party who signed on the loan. Generally without a favor from the mortgage co, the only way off the loan is to refinance or to sell the property. Even with a court order, the lender will not enforce what the court orders. Try to have the EX refinance the property asap.

Welcome Guest,

You will have to ask her to refinance the mortgage in her name in order to get your name removed from the mortgage docs.

Hey Guest,

Since the lender will most likely deny any request from you to refinance the mortgage, your ex will need to do this. However, until the court tells her to refinance, she doesn't have to.
