DOes my girlfriend need to have her sister quit claim deed her home back to her before she claims a Ch. 7? She (my girlfriend) quit claimed it to her last year to avoid foreclosure? Is it true she can t claim this property if its been quit claim deed to her sister?

Hi pbc12play,

Welcome to the forum.

Once your girlfriend has signed a quitclaim deed to her sister, she has no claim on that property but her sister can quitclaim back to her if she wishes. But the problem here is that if she quitclaims the property back to your girlfriend just now before signing filing the BK then it may be considered as a fraudulent conveyance and she may face problem in future.

Pbc, if your friend has already quitclaimed her property and given up all her interest in it, she can no longer use the house as an asset for chapter 7 bankruptcy. However, depending upon the bankruptcy laws in your friend's state of residence, she may or may not be able to use the home as an asset that can be liquidated.

It is better to talk to a bankruptcy attorney in this regard.

Welcome to our forums.

It seems that your half-sister wants you to quitclaim your father's estate as stated in the Will so that she gets more than what is allotted for her. I guess you have the right to quitclaim on behalf of your father. But would you be interested to lose a part of your share in the property interest? Can you please explain your situation in details? It will help me guide you in a better way.
