My sister and I have been deeded my parent's home by quitclaim now that they have passed away. We had agreed to sell the asset and split the proceeds but now she wants to move into the house and live there with her boyfriends and many animals. I live overseas. How can I force a sale of the house? The house is in Brevard County in Fla.

Hi jacgem.

Welcome to the forum.

You can ask you sister to buy you out. That means to pay you for your share of the property. So if she pay you your share of the property then you can simply quitclaim to her.

Hope that will solve you problem. So talk to her see what she says.

I would love to have this option, but she is both broke & a bankrupt. The house is an upscale dwelling, on the water within a barrier island. This also translates into high annual operating costs which she cannot afford as she only works part time. I need to know if I an force a sale, even if below market (low anyway!) price. Thanks!!

Hi jacgem.

Welcome back.

You can file Partition lawsuit to force her sell the property. After selling the property the sell precede will be divided by the court between both of you. to know more about partition lawsuit have a look at http://www.mortgagefit.com/know-how/removecoborrower.html

Hope it helps. Feel free to ask if you have any further questions.

Best of luck,
Larry
