When my mother passed away, she left her home and property in her husbands name thru a quitclaim deed, but he had not lived with her in 6 years. He owns property in another state, and now owns 3/4 of her estate, and I, her only child, owe 1/4. Can I apply for a Grant deed, and how? He lives in her home now, and has removed me and my 2 children, whom were raised in this home, from the property. Is there any way I can fight this?

Welcome joyhender,

I suppose your mother hasn't left a Will behind and she has transferred the entire property in her husband's name. Now, the problem is, even if you sign a grant deed, it's not going to let you have the property until and unless the current owner, that is the husband transfers a share of interest or the entire property over to you. So, the husband needs to sign on the deed as the grantor.

Hi joyhender,

Welcome to the forum.

If your mother quitclaimed the property to your father then how do you own 1/4 of the property?

Is there any mortgage on the property? If this is a mortgaged property then are you also on the mortgage?

If it is not a mortgaged property and if you own the property then why do you want a Grant deed?

Please clarify these questions so that we can answer or give any suggestions.
