I need advice. my mom and stepdad divorced in april she signed a quitclaim deed because he couldn’t get the mortgage refinanced in just his name. Dec he passed away. what falls on my mom now? he hasn't made a payment since july or paid taxes. is she responsible for the up keep of the house until its taken or because of the quitclaim deed she has not rights to the house and all the debt is going to fall on her?

you need to talk to a real estate attorney.

dont get your advice here for something like that

Hi niannie,

If your mother's name is on the mortgage docs now, then she will be liable for paying off the loan in full. However, she won't have any ownership rights on that property as she had already quitclaimed it.
