I do not understand how a quitclaim deed can remove my deceased husbands name from the deed. Is he not the grantor?

I am in the process of refinancing my house. The mortgage co. says that I need a quitclaim deed to remove the name of my deceased husband from the deed. I don't understand how this accomplishes that because isn't he the granter?

Hi cbuie,

As your husband is deceased now, you won't be able to use a quitclaim deed to transfer the property to your name. You will have to file an affidavit of heirship at the county recorder's office in order to get the property transferred in your name. Then you can refinance the mortgage.
