We are going thru a divorce and my STBX wife wants me to accept a quit claim deed from her for our existing house which we are going to have to sell. The reason she wants to do this is because she wants to proceed to buy a different house. My concern is that the new house will then be completely my financial responsibility. She is currently living there and I have no desire to live there if she moves.

So what you are saying is she wants to live there until she has a new home and wants you to be solely responsible for it. Sounds like a great deal for her.

Where do you live?

Do you have kids together?

Are you both on the mortgage?

Hello,

If both of you are on the mortgage, then only the quit claim cannot release her from the loan. She can transfer the property by a quit claim but the mortgage still has her name on it.

if the property is yours not your wife, the quitclaim can sucessfully. otherwise, only a side doing a quitclaim is invalid.
