I was divorced 4 years ago and signed a quit claim over to my ex-wife becasue she agreed to refinance the house in her name only. She never did and is now trying to obtain a modification loan to avoid a foreclosure on the property because it is now delinquent. I want no part of it and only want my name removed from the loan. Can I legally ask for the house to be sold? What options do I have? Me and my new wife were planning on buying a new home later this year and am now afraid this will hurt us.

Hi,

You cannot legally ask your ex-wife to sell the property. This is because you have given up your rights through a quitclaim deed. However, you can request her to sell it off and pay off the mortgage and allow her to keep the profits if any. This is because the sale proceeds can be used to pay off the loan and this will in turn will stop affecting your credit negatively.
