my ex wanted me to quitclaims the mortgage but he says the house is up for foreclosure. what is in it for him

Hi gwen.

Welcome to the forum.

I don't understand how can you quitclaim the mortgage? You can only quitclaim the property. Actually quitclaim is a deed that is generally used to transfer property. You husband can refinance the mortgage on his name only to remove you name from the loan.

Wait a minute, is he asking you to refinance the mortgage on your name only just before the foreclosure? Oh that will be horrible request. I think you should ask him what exactly he wants. BTW do not refinance on your name only as that will make you responsible for the deficiency judgment is the sell price is lesser than what you owe to the lender.

you can quit claim for house, but the mortgage can not been quit cliam.
