quick claim deed

My sister has been paying for her home for almost 7 years now. Her name is the only one on the mortgage.

Her boyfriend moved in to her home about one year and three months ago. When he moved in initially, he agreed to pay half of the bills, including the mortgage.

Though, shortly thereafter, he threatened her to put his name on the house, or he'd quit paying his half. She gave in and signed a quick claim deed. This deed was signed a year ago.

They are now nearing a breakup and he is threatening to take her to court and take half of everything, including the house. What are his legal rights to the house, if any? What advice should I give her?

Hi guest,

Since your sister has quitclaimed the property to the boyfriend, therefore he has the entire rights of ownership. However, if your sister can legally prove that she has been threatened to quitclaim the property, there's a chance that the court may help her get back the property. What you need to do now is take her to a reputable attorney who'll assist her in fighting out the case.

Does he still have entire rights to ownership if both of their names are on this deed?

Hi Diana1,

Since the names of both your sister and her boyfriend are on the title, I don't think he enjoys the entire right to the property. It depends on whether your sister quitclaimed her share in the property, in whole or in part. I don't think she deeded the whole of the property to him, otherwise her name wouldn't have been on the deed.
