My father passed away 12 years ago my brother has been living in his house since he died. My father had no will and 12 children. now my brother wonts to get married and his girlfriend wants us to sign a quit clame . I am afraid to sign it because I dont wont to loose my rights to my fathers property to a stranger, my question is do all of have to sign and what if one refuses ? If I sign it will I loose all rights if she or my brother pass away.

Welcome to the forums!

I completely understand your situation. Once you quitclaim the property in your brother's name or his girlfriend's name, then you will lose all the interest in the property. Yes, you will not have any right to the property if they pass away. However, if you mention the clause of "life estate" in the quitclaim deed, then you will have "absolute right" to stay at the house until your death.

In case you do not sign a quitclaim, they may offer you your share of money and ask you give up your interest in the property. This is known as buyout co-owner.

Yes, if you quitclaim the property to anyone else name then you will lose all the interest in the property. If you mention the clause of life estate then it will be a different issue and you will be able to stay in the house until death.

you can refuse to sign a quitcliam deed, or sign the quitclaim deed but simultaneously, you can sign a life estate. Life estate will make you to stay in the home legally until death.
