My Mother didn't leave a will but on the deeds to her property she put her name on it plus the word as estate. Can i transfer it to me as the surviving son using a quit claim deed. Also My mother passed away in 1975 and I have been paying taxes on this property since then.

If your mother would have been alive, then she could have signed a quitclaim deed and transferred the property to you. However, as she is no more, you will have to file an affidavit of heirship at the county recorder's office and get the property transferred in your name.

Hello guest,

A deed releasing a person's interest in a property without stating the nature of the person's interest or rights, and with no warranties of ownership. While a quitclaim deed neither warrants nor professes that the grantor's claim is valid, it does prevent the grantor from later claiming they have an interest in the property.
